Senior Counsel demands judicial clarification on bail denial for Besigye, Lutale

Senior Counsel Henry Kunya has called for a judicial explanation regarding Justice Rosette Comfort Kania’s decision to deny bail to prominent opposition figure Dr. Kizza Besigye and businessman Hajji Obeid Lutale.

This demand follows a strong condemnation from the Uganda Law Society (ULS), which accused Justice Kania of violating the law in her April 11, 2025 ruling.

Dr. Besigye and Lutale are currently facing unspecified criminal charges related to treason.

During a public and media engagement weekly event held by the Radical New Bar under ULS at Kololo, Counsel Kunya emphasized the judiciary’s obligation to provide clarity on the bail denial, asserting that it is a fundamental right for individuals to seek bail.

Kunya remarked that judicial transparency is crucial, and there should be a clear explanation from the court regarding the reasons for denying bail to Besigye and Lutale.

In response, ULS Treasurer Arthur Isiko criticized Justice Kania’s decision, labeling it as illegal and based on unfounded speculation, which, he argued, is not an acceptable basis for legal interpretation.
