The High Court in Kampala has denied bail to opposition politician Dr. Kizza Besigye and his Personal Assistant, Hajji Obeid Lutaale, citing concerns that their release could interfere with ongoing investigations.
In a ruling today, Lady Justice Rosette Comfort Kania from the Criminal Division pointed to the gravity of the treason charges against them as a key factor in the denial.
While acknowledging the principle of presumption of innocence and the right to personal bail, Justice Kania emphasized that this right should not serve as a means to circumvent the law.
She highlighted that both Besigye and Lutaale’s places of residence fall within the jurisdiction of the court, supported by evidence such as identification cards and local council letters.
The Judge found the sureties presented by Besigye to be substantial; they include close friends and party leaders who would exert influence over him.
Similarly, the sureties for Lutaale, which include family members, were deemed suitable despite their younger age.
Justice Kania cautioned against establishing a precedent requiring sureties to be older than the accused, asserting that it would unfairly impact older defendants seeking bail.
However, the judge concurred that Besigye posed a risk of interfering with police and state investigations currently in progress.
Both accused have been in custody since November 16, 2023, and are charged with treason, with prosecutors alleging they conspired with a UPDF captain, Dennis Oola, to overthrow the government.
